The service
Bandera Negra generates a personal pirate emblem from a photo of you and your answers to an eight-question questionnaire. The emblem and the role are automatically generated creative fiction; they do not describe any real person.
Accepting these terms
By creating an account or using the service you accept these terms and the privacy notice. If you do not agree with them, do not use Bandera Negra.
Minimum age
Bandera Negra is for people aged 18 and over only. By registering you declare that you are at least 18 years old. The service is not directed at minors and we do not knowingly process their data.
If we find that an account belongs to a minor, we will close it and delete the associated photo, answers and emblems. If you believe a minor has registered, write to contacto@banderanegra.app and we will act as soon as possible.
Account and access
To use the service you need to sign in with Google or with a link sent to your email address. You are responsible for access to your email account and for activity carried out from your account.
Each person may hold one account only. Do not share your account or create additional accounts to get around the usage limits.
Free service
Bandera Negra is free to use: we do not charge for registering or for generating emblems, and we do not ask for payment details. If we add paid features or products in the future, they will be optional, governed by their own terms, and announced in advance.
The service being free does not oblige us to keep it available or to store your emblems indefinitely.
Acceptable use
- You may only use photos of yourself. Do not upload photos of other people.
- The service is for adults only. If the photo shows someone who appears to be a minor, generation is blocked and the photo is deleted.
- Do not use the service to harass, impersonate or defame anyone, or to generate illegal, hateful, violent or sexual content.
- Do not attempt to get around the usage limits, automate the service, scrape data in bulk, reverse-engineer the system or overload it.
Limits
You can obtain one emblem per calendar day and make at most three attempts per calendar day. The day is counted in your device's time zone: after an emblem today, you can create the next one from midnight. Blocked or failed generations do not count as a delivered emblem, but they do count as an attempt.
To keep the service free we also cap the total number of emblems generated each day across all users. If that cap is reached, we will ask you to try again the next day.
Moderation
We automatically review the photos submitted to the service. We may block a generation, withdraw an emblem or suspend an account where there is a breach of these terms or a legal risk. Where reasonable, we will tell you why.
Your content
By uploading a photo you declare that you are the person shown in it and that you have the right to use it. You grant us a non-exclusive, royalty-free and limited licence to store and process it — including sending it to the AI providers we use — for the sole purpose of generating your emblem and operating the service.
Ownership of the emblem
You may use your emblem for personal purposes, including sharing it on social media. We do not transfer to you any rights over the name, the brand, the site design or the other elements of the service.
Because it is an automatically generated image, the emblem may not be protected by copyright in Mexico or in other countries, so we cannot guarantee you exclusivity over it or over similar results obtained by other people.
We will not use your emblem, your name or your image in promotional material or on products without your prior consent.
You grant us a licence to keep the emblem together with your answers in order to operate and improve the service, on the terms of the privacy notice.
Site mark on the emblem
Every emblem includes the site name embedded in the image. When sharing or printing your emblem, do not remove, crop or conceal that mark.
Third-party services
Bandera Negra relies on external providers for authentication, hosting and AI image generation. When you use the service, your data is also processed in those systems, as detailed in the privacy notice.

How your photo and your data are processed is described in the privacy notice, which forms part of these terms.
No guarantee of results
The service is provided "as is" and "as available". We do not guarantee that generation will succeed, that the result will meet your expectations, or that the service will run without interruptions or errors. We may suspend or withdraw the service at any time.
Liability
To the extent permitted by law, we are not liable for indirect damages, loss of data or loss of profit arising from use of the service. Nothing in these terms limits the rights granted to you by the Mexican Federal Consumer Protection Law or any liability that cannot lawfully be excluded.
Suspension and closing your account
You can close your account at any time from "My emblems" (/me) or by writing to contacto@banderanegra.app. We may suspend or close your account if you breach these terms or if we stop operating the service. When the account is closed we delete your photo, your answers and your emblems within the periods set out in the privacy notice.
Versions and changes
These terms carry a version date. We may update them; if we do, we will ask you to accept the new version before you continue using the service.
Severability
If any clause of these terms is found to be invalid or unenforceable, the rest remains in force.
Governing law
These terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, without prejudice to your rights as a consumer.
